Rental Terms & Conditions

Welcome to Florida Villas & Homes by Elite LLC, aka Elite Vacation Homes and/or its affiliates and partners ("Management Company", "We") provide property rentals and management in the Kissimmee area subject to the following conditions. If you place a booking with us, you accept these conditions. Please read them carefully. In addition, if you place a reservation through one of our affiliates or partners, you will be subject to the guidelines, terms, and agreements applicable to such business.

This contract is between the Management Company and the party leader ("You", "Guest") who must sign the booking form accepting these conditions on behalf of all persons named on the booking form ("Guests"), including those substituted or added by agreed amendment of the booking. Only persons named on the booking form are entitled to use the property. A contract exists when you have paid a deposit and the Management Company has confirmed the reservation in writing.

Payments and How to Confirm My Booking?

Cancellation Policy:
Non-Refundable $300 initial payment is required to confirm your booking. The balance Due 30-days before arrival date – 100% non-refundable at that time. Any payments made before 30 days prior to arrival are non-refundable.

Any changes to reservations will incur a $25 charge unless it is an addition to an existing reservation. For your protection, we highly recommend you purchase travel insurance.

Guest Responsibility/Damage Reporting

Guests must treat the vacation rental, its furniture, fittings, utensils and other facilities with care and respect. Any loss or damage incurred to the vacation home must be immediately reported to the Management Company. You will be responsible for any loss, damage or breakage caused during the stay.

Property Protection

As a registered guest in a privately-owned self-catering accommodation, you are responsible for the loss or damage of the rental unit and its contents. A non-refundable property protection fee is assessed to every reservation to cover any accidental damages with a maximum of $500.00 on pool homes and $300 condos and townhomes. Accidental damages are defined by the management company.

Protection Period

Your protection begins from your arrival date until the morning of your departure. Any existing damage or concerns, discovered in your accommodation on arrival, must be reported to Elite Homes within 24-hours.

Extra Fees - Not Covered Under Accidental Property Protection Fee

Charges will be applied for lost keys ($125) or keys not returned to the designated drop off location at the end of stay ($45). Extra charges will be assessed for excess trash found on departure (more than 2 black bags), smoking in the home, unauthorized pets, frozen air conditioning unit caused by leaving doors/windows open with setting below 72F, blocked toilets needing plumber/management company being called out due to excessive paper or foreign objects, unauthorized late checkout past 10:00 a.m., unreported accidental damages, broken/torn screens in pool area, barbecue grill stains from use on the pool deck (Please make sure all grilling is done outside of pool area.), broken glass windows or doors, stained linen (including sheets and towels. (Please do not use bleach), stained/discolored carpets, missing TV remotes, after-hours non-emergency calls, moved furniture not put back into place, missing items, and any other deliberate damage or gross negligence as determined by the Elite Homes team.

Extra rental charges will be applied to guests using non-authorized bedroom(s). For example, a free upgrade is granted, and the extra bedroom(s) are locked off by the Management Company. Any unauthorized entry into the locked off bedroom(s) will incur an automatic charge to reflect the retail price of the upgraded home including an increase in cleaning, if applicable.

Resort Fees - Fantasy World Resort Only

Free Resort Fees for 6 guests included. Cash deposit or credit card authorization of $75 each, for resort arm band and an additional $350 authorization or deposit to cover potential damages.

Resort Fees - Emerald Island Resort Only

All guests are required to purchase a single access card, per car, upon arrival. The guard will direct you to the clubhouse to make the purchase. Non-refundable fee is $20 per car, including tax. Only cash or debit will be accepted for payment.

Recreational Vehicles, motor homes, boats, trailers, trailered smokers or grills, buses and campers cannot be parked on the Resort. A maximum number of vehicles, per home, permitted is 3.

Incidental Damage/Security Deposit

A credit card authorization form, signed by the cardholder, granting Florida Villas & Homes permission to place a deposit/hold in the amount of $350 for any incidental damage fee charges is required.

The deposit/hold will be released within three (3) to five (5) business days after your departure.

Pool/Spa Heating Notice

Guests acknowledge that lifeguards are not provided at the vacation home’s swimming pool. Guests are responsible for the safety of themselves, their children, and their guests. NO reciprocal agreements exist between properties. Pools are for the use of vacation home residents and registered guests only. Pools will be cleaned weekly by staff. During this period there may be times when the pool must be treated, causing to be unusable by guests. This will be done according to the pool maintenance department schedule and cannot be scheduled according to the guest’s request. During some occasion when it rains or when screen doors are left open, bugs and debris may get into the pool. We have provided each pool with a net in case this happens.

For guests who have paid for pool/spa heating, please read the following details carefully. Pool/Spa heating is available for the full duration of your stay. It is not available for individual nights and must be reserved at least 3-days prior to arrival date. If pool/spa heat is requested mid-stay, there is a $35 call out fee to turn on pool/spa heat. Please note: not all properties have a pool/spa heater.

There is a supplemental fee starting at $ 30.00 + tax, per night, for pool/spa heating. During winter months, pool/spa heaters will generally heat the pools to approximately 82°Fahrenheit. However, if the air temperature lowers to 60°F or less, the pool/spa heaters may become ineffective, failing to warm the water to a comfortable temperature. In these cases, a refund of a portion, or all monies paid is not possible; your understanding of this matter is an essential part of this reservation.

It takes approximately 12 to 24 hours for the full warmth to be felt. A temperature of 80°F-85°F degrees can be expected. Pools pumps are on for approximately 8-hours per day. Heaters will heat to a maximum of 10°F lower than the outside air temperature.

If the pool has a blue pool cover, please make sure this is placed on the pool in the evening when the pump is not operating. It will retain the warmth generated during the day.

Credit Card Chargeback Policy

For every chargeback received from the Property Management Company’s acquiring bank, the Property Management Company will charge the Tenant a $100 non-refundable chargeback fee. This fee is mandatory to cover the administrative costs associated with the chargeback process.

Damage Reporting

Guests must treat the vacation home, its furniture, fittings, utensils and other facilities with care and respect. Any loss or damage incurred to the vacation rental must be immediately reported to the Management Company. You will be responsible for any loss, damage or breakage caused during the stay.


All properties are limited to the bedding capacity and to registered guests. The Management Company reserves the right of eviction for unauthorized occupancy (maximum occupancy standards are regulated by the county fire chief and local authorities).


Check-in time is after 4:00 p.m. on the day of arrival. Check-in time may be slightly delayed on rare occasions. It is never guaranteed, and compensation will not be granted for late access.


Check-out time for all properties is strictly 10:00am on the day of your departure. Any request for a late check-out must be previously approved by the Management Company within 48 hours of departure. Late check-out is subject to property availability as well as an additional charge. Late check-outs may not be available during peak & Holiday periods.


Florida Law requires that sales tax and occupancy hotel-motel tax be collected on all rentals. Tax requirements are subject to change by state and local taxing authorities.

Rent at your own risk - COVID-19 Warning

We have taken enhanced health and safety measures for our guests, employees, and larger community. You must follow all preventative measures aligned with the recommendations of the Centers for Disease Control and Prevention (CDC), World Health Organization (WHO), local health agencies and health information while staying in your vacation rental as well as traveling outside of the home.

An inherent risk of exposure to COVID-19 exists in any public accommodation or place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable.

By staying in a Florida Villas & Homes, by Elite LLC aka Elite Vacation Homes accommodation, you voluntarily assume all risks related to exposure to COVID-19.

The Management Company cannot offer any refunds due to early departure and/or eviction from the vacation rental. No refunds or reductions in rent are granted for mechanical failures or malfunction, interruption of utilities or other maintenance problems concerning air conditioners, heaters, dishwasher, washers, dryers, televisions, DVD/VCR players, swimming pools, other appliances, and amenities.

Minimum Length of Stay

Length of stay requirements vary by vacation home and time of year. Please contact us if you have any questions.

Property Guarantees & Substitutions

The Management Company strives to comply with all reservation requests for specific vacation residences. However, due to changes in residence ownership, unforeseen mechanical problems, or any other circumstances, we cannot guarantee a specific rental property. We reserve the right to change assignments without notice or liability should a residence become unavailable. We do not guarantee a specific vacation home, although every effort will be made to provide the requested home and/or provide comparable or more amenities.

Group Reservations

Due to COVID-19, at this time, Elite Vacation Homes may not be used for events or group gatherings that exceed maximum occupancy. Only guests whose names are on the reservation are authorized to stay in the home. Any guest having events or group gatherings in the home or exceeding the numbers of authorized guests will be immediately evicted without refund. Please ask our sales specialists for more information.


The Management Company will not rent to vacationing students or singles under 25 years of age. Any reservation made under false pretenses will be subject to forfeiture of advance payment of rent and deposit as well as possible eviction.


Loud or unusual behavior is strictly prohibited. The Management Company reserves the right to evict, without refund, any person who creates a disturbance or become a nuisance. Violation of any vacation home rules, including but not limited to the throwing or dropping of any object from patios and balconies, will result in an immediate eviction without refund.


All vacation home and long-term residences are designated as non-smoking. Smoking is permitted outside of the home on the outside patio. If evidence of smoking is found in the home, there is an automatic charge of $500.00 to cover the cost of professionally cleaning carpets and upholstery. Should a professional company services be necessary, additional charges will be incurred to cover those expenses. Thank you for your help and consideration.


Pets are not permitted. If evidence of a pet is discovered in the rental, without prior authorization, a $500 charge will be applied to the responsible party on file to cover the cost of professionally cleaning carpets and upholstery. Vacation Home Parking

The number of available parking spaces will vary according to each vacation rental. Many properties have restrictions for trucks, campers, boats, trailers, etc. Do not park on the grass lawn or you may damage the underground sprinkler system and will be held liable. WINDSOR HILLS RESORT: Maximum of 3 cars permitted.

Barbecue Grills

Florida state law does not permit barbecue grilling on the pool deck within the pool screen enclosure. Please make sure all grilling is done outside of pool area.

Cribs, Highchair and Sofa-Beds

Cribs, pack-n-plays, toddler beds, wheelchairs, scooters, and swimming pool lifesavers are available for rent by the Management Company for an extra fee. At least 72-hour notice in advance is required.

Telephone Service and Charges

All residences have a telephone, which is not connected to a central switchboard. Local and toll-free calls are included with the reservation, and a pre-paid phone card is required for long distance calls. For more information, please contact our main office.

Key Collection/Return/Lockout

Charges will be applied for lost keys ($125.00) or keys not returned to the designated drop off location at the end of stay ($45.00).

PLEASE DO NOT EXIT THROUGH THE GARAGE. Should you be locked out of your rental residence, during office hours, a spare key will be provided for you. You may pick up the spare key from the registration office for no additional charge. An after-hours lock-out where our team travels to deliver a spare key, will result in a $100.00 charge.

In the event a locksmith is required, we will help contact one for you. The locksmith must be paid directly by yourself. Any spare keys issued to you must be returned upon departure or they will be considered lost and subject to locksmith fees.

Entry of Premises

Entry of Premises An authorized employee or repairman may enter your rental during regular business hours for any purpose connected with repair, improvement, care, and maintenance of the premises. The vacation home you occupy may be listed for sale. If so, there is a possibility that our real estate office will call you and request a convenient time for a showing during your stay. Every effort will be made to schedule showings to not interrupt your vacation.

Trash Collection/Disposal Procedures

For individual home instructions by address, please refer to the guest book and signage placed through your rental home.

Trash should be placed in the appropriate trash bin, usually located on the side of the house or bench by the front door. Please contact the office if you are uncertain where your trash bin is located. Please move the trash bin to the outside curb on appropriate day, then bring it back again after collection.


ALL TRASH IS REQUIRED TO BE BAGGED. No small trash bags less than 13-gallons accepted. Violators will be charged a $100 excess trash fee.

You MUST use trash bags no bigger than 13 gallons and they must completely line the trash bin. Small bags, open, torn, scattered or broken bags, will not be picked up. Please break down all card boxes. Do not include needles or other sharp objects. Place your securely tied waste in your trash container.

Trash is collected only once per scheduled day. Heavy bags over 30 lb will not be picked up. Construction materials are not collected. Please take extra trash to the garbage compactor located at the main entrance of the property. (Otherwise, there will be a violation fee.)

Non-service Holidays: New Year's Eve, New Year's Day, Easter Sunday, Memorial Day, 4th of July, Halloween, Thanksgiving Day, Christmas Eve and Christmas Day.

Agency Disclosure

The Management Company is a representative of its owners in its rental program and is acting at all times in and for the best interest of the owners and guests.

Force Majeure

The owners of the vacation home or their servants or agents shall not be liable for any damages or other losses resulting from failure to perform its obligations where such failure is the result of a cause beyond the party’s reasonable control, for any loss or delay due to, but not limited to, any of the following: Strikes, Riots, Political Unrest, Hostilities, War, or threat of War, Terrorist Activity, Closure of Airports, or any other event beyond the owners’ control. This also includes, but not limited to, losses during Hurricanes, Storms, and Pandemics.
